Abstract

 The Chilean Constitutional Court decision related to the bill that decriminalizes abortion for three cases, contains a radical jurisprudential shift for the recognition of natural rights as a limitation of sovereign power, and in particular, to legislative activity. The reasoning of the Constitutional Court not only affects the content of the right to life but also impacts the system of rights and the understanding of the relationship between people and the government. Its consequences are evident in the dissenting opinion concerning the regulation of conscientious objection.
